The Bedford and Shires Health and Care and the South Bedfordshire Community Health Care National Health Service Trusts (Dissolution) Order 1999
The Secretary of State for Health, in exercise of the powers conferred on him by section 126(3) of the National Health Service Act 1977[1] and by section 5(1) of, and paragraph 29(1) of Schedule 2 to, the National Health Service and Community Care Act 1990[2] and of all other powers enabling him in that behalf, considering it appropriate in the interests of the health service to make this Order[3], and after completion of the consultation prescribed under paragraph 29(3) of Schedule 2 to the latter Act[4], hereby makes the following Order: Citation and commencement 1. This Order may be cited as the Bedford and Shires Health and Care and the South Bedfordshire Community Health Care National Health Service Trusts (Dissolution) Order 1999 and shall come into force on 1st April 1999. Dissolution of NHS trusts 2. - (1) The Bedford and Shires Health and Care National Health Service Trust established by the Bedford and Shires Health and Care National Health Service Trust (Establishment) Order 1992[5] shall be dissolved on 1st April 1999, and accordingly that Order revoked on that date. (2) The South Bedfordshire Community Health Care National Health Service Trust established by the South Bedfordshire Community Health Care National Health Service Trust (Establishment) Order 1991[6] shall be dissolved on 1st April 1999, and accordingly that Order revoked on that date. The Bedfordshire and Luton Community National Health Service Trust (Establishment) Order 1999
The Secretary of State for Health, in exercise of the powers conferred on him by section 5(1) of, and paragraphs 1, 3 and 6(2)(d) of Schedule 2 to, the National Health Service and Community Care Act 1990[1] and of all other powers enabling him in that behalf, having completed the consultation prescribed by section 5(2) of that Act[2], and considering it appropriate to include, among the functions of the NHS trust established by this Order, functions in relation to the provision of services by the trust for one or more Health Authorities or Special Health Authorities[3], hereby makes the following Order: Citation, commencement and interpretation 1. - (1) This Order may be cited as the Bedfordshire and Luton Community National Health Service Trust (Establishment) Order 1999 and shall come into force on 1st April 1999. (2) In this Order, unless the context otherwise requires-
Establishment of the trust
(b) to provide and manage pursuant to section 5(1)(b) of the Act the properties listed in Part I of the Schedule, and there to provide and manage hospital accommodation and services; and (c) to provide and manage pursuant to section 5(1)(b) of the Act the properties listed in Part II of the Schedule, and there and from there to provide and manage community health services. It also provides for the functions of the new trust (article 3). It specifies the number of executive and non-executive directors of the new trust (article 4), its operational date (the date on which the new trust assumes all its functions) and its accounting date (article 5), and the value above which assets cannot be disposed of without the Secretary of State's consent (article 6). The new trust replaces the Bedford and Shires Health and Care and the South Bedfordshire Community Health Care National Health Service Trusts, and this Order should be read in conjunction with the Bedford and Shires Health and Care and the South Bedfordshire Community Health Care National Health Service Trusts (Dissolution) Order 1999[5].
